Waiver and RELEASE: I understand and agree that my use of the Club, or any other participating Upgraded Industries facility, involves the risk of injury to me or my guest whether caused by me or not. I understand that these risks can range from minor injuries to major injuries, including death. In consideration of my use of the facilities offered by the Club and other participating Upgraded Industries facilities, I understand and voluntarily accept this risk and agree that the Club and other participating Upgraded Industries facilities, and their respective members, managers, employees, agents and independent contractors will not be liable for any injury, including personal, bodily, or mental injury, economic loss or any damage to me, my spouse, domestic partner, guests, unborn child or relatives, resulting from the negligence of the Club, or any participating Upgraded Industries facility, or anyone on the Club’s or such other Upgraded Industries facility’s behalf, whether related to exercise or not. Accordingly, I do hereby forever discharge the Club, and each other participating Upgraded Industries facility, from any and all claims, demands, injuries, damages, actions, or causes of action whatsoever. I further understand and acknowledge that the Club does not manufacture fitness or other equipment in its facilities, but purchases and/or leases such equipment, and therefore the Club and other participating Upgraded Industries facilities may not be held liable for defective products. As a parent/legal guardian, I agree to this release and hereby indemnify and hold harmless the Club and other participating Upgraded Industries facilities, and their respective members, managers, agents, and independent contractors for any claim brought by my minor child against the Club, and each other participating Upgraded Industries facility.

CLUB ENHANCEMENT FEE: The purpose of the annual Club Enhancement Fee is to maintain and improve the equipment and services provided for the facilities. This fee of $0.00 (includes tax) will be collected on and on the same date of each year thereafter. (The Club Enhancement Fee will not be charged to PIF members.)
PARENT/GUARDIAN: In exchange for Upgraded Industries allowing my minor child to purchase a membership, I agree to the terms of this Contract, including the Waiver and Release clause in this Contract, and I agree to defend and indemnify Upgraded Industries to the fullest extent permitted by law for any claim brought by my minor child against Upgraded Industries. I also promise to pay all financial obligations that my minor child does not pay for any reason and acknowledge that the banking information below is my account.
